THE present writ petition has been preferred under Article 227 of the Constitution of India against an order passed by the Trial Court in Title Suit No. 15 of 2006 dated 22nd May, 2008, below an application preferred by the original defendants under Order XXVI Rule 9 of the Code of Civil Procedure for appointment of the Court Commissioner and as the Court Commissioner has been appointed at the behest of the original defendants, original plaintiffs have preferred this writ petition.
(2.) HAVING heard learned counsel for the petitioners and looking to the facts and circumstances of the case, I see no reason to entertain this writ petition mainly on the following facts and reasons:
