JUDGEMENT

(1.) With consent of parties, this restoration application was taken up.

(2.) It is submitted that on 9.3.2007, this second appeal was dismissed for non prosecution. It is further submitted that the reasons for non-appearance and the delay in filing this application have been explained. Heard.

(3.) On being satisfied with the grounds, the delay in filing CMP is condoned and CMP is allowed by restoring S.A. No. 213 of 2004 to its original file.
