JUDGEMENT

(1.) HEARD Sri D.K.chakravorty, learned counsel for the petitioner and Sri Ananda Sen, learned counsel for the respondent C.C.L.

THE petitioner in this case had originally prayed for a writ of certiorari for quashing the order dated 15.10.2004 (Annexure -10) passed by the Respondent No. 5 whereby it was held that the petitioner was not entitled to receive Pension, Dearness Allowance and other reliefs under the Central Government Pension Rules.

(3.) LEARNED counsel for the petitioner informs further that a circular has been issued recently by the Central Government under which the amount of pension has been enhanced by 20% in favour of such retired government employees who have crossed the age of 80 years and the petitioner is therefore entitled to the enhanced amount of pension on the basis of the circular.
