JUDGEMENT

(1.) HAVING heard learned counsel for both the sides and looking to the evidence and the judgment and order of conviction and sentence, passed by the trial court, this appeal is Admitted for final hearing.

(2.) RECORDS and proceedings of Sessions Case No. 51 of 2006/46 of 2006, arising out of Jama P.S. Case No. 76 of 2005 are called for from the Court of learned 4th Additional Sessions Judge, F.T.C., Dumka.

(3.) WE have also heard learned counsel for both the sides for suspension of sentence, under Section 389 of the Code of Criminal Procedure, 1973, awarded to the appellants -accused persons by the trial court for the offence mainly punishable under Section 302 of the Indian Penal Code, during pendency of this appeal.
