JUDGEMENT

(1.) The petitioner, who is the defendant in Eviction Suit No.03 of 2012, is aggrieved of order dated 28.07.2016 by which his application for examination of signature of the tenant on the agreement dated 01.04.2010 has been rejected.

(2.) The respondent has appeared through Md. Sajid Yunus, the learned counsel.

(3.) Mr. Ramawatar Choubey, the learned counsel for the petitioner submits that in his written statement the petitioner has specifically denied his signature over the alleged agreement dated 01.04.2010 and therefore it became necessary to verify the signature of the tenant on the said agreement. Further contention raised on behalf of the petitioner is that the trial court has already formed an opinion that the plaintiff is the owner of the disputed premises.
