BALKRISHNA KUMAR Vs. STATE OF JHARKHAND

JUDGEMENT

(1.) The petitioner is seeking compassionate appointment on the ground that his father had died in harness.

(2.) Father of the petitioner was working as Assistant Teacher in Middle School Upar Bahiyar, Sarath, Deoghar. He died on 10.1198 At the time of death of his father he was aged about 2 ' years. In "National Institute of Technology & Others vs Niraj Kumar Singh, (2007) 2 SCC 481" , the Supreme Court has declined to approve the order passed by the High Court for compassionate appointment to a dependant who was about one year of age at the time of death of his father. Now, 36 years after the death of his father the petitioner cannot lay a claim for his appointment on compassionate ground.

(3.) In view of the aforesaid facts, no direction for compassionate appointment to the petitioner can be issued and accordingly, the writ petition is dismissed.
