JUDGEMENT

(1.) Heard the parties finally.

(2.) THE petitioner has filed this writ petition against refixation of his pay scale by deducting it with effect from 14.9.1994 from Rs. 2330 to Rs. 2160. - -

(3.) MR . Sidharth Ranjan, appearing for the board on the other hand submitted that as the petitioner was granted promotion wrongly about which the petitioner knew that he was not entitled, no opportunity of hearing was required to be given to him by the Director of Accounts when he found that the petitioner was wrongly given promotion. However, he could not dispute that in view of the Full Bench judgment, opportunity of hearing should have been given to the petitioner before refixation.
