GOLAK GOPE Vs. STEEL AUTHORITY OF INDIA

JUDGEMENT

(1.) THE present writ petition has been preferred by the petitioner for quashing of order dated 13.2.2007 whereby he was informed by the respondent no. 2 that he would retire from the services of the company on 30.4.2007 on attaining the age of superannuation i.e. 60 years. He further prayed for a direction upon the concerned respondents to reinstate and allow him to continue in service till 30.4.2010. His further prayer is for a direction upon respondent no. 4 to pay pension to him as he has already superannuated from the services of the company on 30.4.2007 on attaining the age of 60 years.

(2.) THE aforesaid prayers seem to be self -contradictory. However the counsel for the petitioner confines her prayer for the claim of his retiral benefit with effect from 30.4.2007. She further made an oral prayer that till date pension has not been fixed by the Provident Fund Commissioner .

(3.) CONSIDERING the aforesaid facts and circumstances of the case, it will be In the fitness of thing that the petitioner files a representation before the Provident Fund Commissioner for fixation of his pension, who will dispose it of within a period of two months from the date of receipt of his representation.
