JUDGEMENT

(1.) THIS is an application for restoration of writ petition being CWJC no. 776/1990r, which stood dismissed in default for non-appearance of the counsel for the petitioners.

(2.) THE application for restoration has been filed stating that the counsel for the petitioners was busy in another court and therefore, he could not appear on the day and time when the matter was called out.

(3.) IN our opinion, this not a sufficient cause for non-appearance as the counsel is duty bound to appear or make alternative arrangement if he is unable to appear for any reason so that the matter does not remain unattended.
