JUDGEMENT

(1.) HEARD the learned counsel for the parties and with their consent this writ application is being disposed of at this stage itself.

(2.) THE petitioner -Palamu Zila Transport Association through its President has filed this application for direction to the respondents to pay compensation amount for the use of vehicles of the members of the Association which was used in Palamu, 2007 Lok Sabha and Assembly Bye -Election Poll by the Authorities at Garhwa from where the vehicles belonging to the members of the Association were requisitioned.

(3.) A counter affidavit has been filed on behalf of the State of Jharkhand. In paragraph 10 thereof, it has been stated that for the purpose of payment of compensation to the owners of different vehicles used in election work, the Superintendent of Police, Garhwa wrote a letter to DIG, Budget, Jharkhand vide letter dated 4.2.2008 for allotment of Rs.9,72,980/ -. It is also stated that the DIG, Budget vide letter dated 22.2.2008 informed the Superintendent of Police, Garhwa that after receiving the allotment the amount of compensation, the same would be released to the Office of Superintendent of Police, Garhwa for the payment of the dues to the vehicle owners.
