(1.) FROM the office note it does appear that carbon copy of Jagarnathpur P.S. case No. 72 of 2007 had been called for by this Court, vide order dated 20.12.2007 but office of Inspector of Police, Jagarnathpur Circle. Ranch sent the case diary of Argora P.S. Case No. 72 of 2007 though in the forwarding letter reference is that of Jagarnathpur P.S. case No. 72 of 2007. It is quite possible that the mistake may have occurred due to inadvertence but it has been pointed out by the office that this kind of mistake on the part of the concerned police official does happen in -variably which not only creates problem for the office of the High Court but it also delays the disposal of the case. However, it can be minimized if due care and diligence is applied by the authority concerned in compliange of the order of this Court.

THAT apart it is being invariably noted that certain documents such as viscera report, post -mortem report or injury report etc., which needs to be part of the case diary, is not made available along with the case diary as a result of which the case is postponed to other date for want of those documents resulting into delay in disposal of the case. It may also be noted that carbon copy of the case diary which is made available to the Court at most of the time is so faint or illegible that one can hardly go through it. The other difficulty which is being faced by the office is that invariably it is being intimated to this Court by the concerned police officer with reference to compliance of the order of the Court asking for the carbon copy of the case diary that the same has been made available in connection with other case but at number of occasions it has been noted by the office that much prior to intimation sent to this Court by the concerned police station the carbon copy of the case diary which had been called for in connection with other case had already been sent back to that police station which indicates about the casual approach of the concerned police personnel towards compliance of the order of this Court which results unnecessarily correspondences and not only this some times case diary is being sent by the concerned police station after getting number of reminders which causes inordinate delay in disposal of the ball application. In order to avoid all these things one needs not to take much effort but to apply due care and diligence in compliance of the order of the High Court. Therefore, let a copy of this order be sent to the Director General of Police, Jharkhand so that necessary instructions in this regard be issued to all concerned the earlier.
