SHASHI KANT JHA Vs. JHARKHAND STATE ELECTRICITY BOARD

Decided On October 15, 2008
Shashi Kant Jha Appellant
V/S
JHARKHAND STATE ELECTRICITY BOARD Respondents

JUDGEMENT

(1.) HEARD the leaned counsel for the parties.

(2.) THE petitioner in this writ petition has prayed for a direction to the respondents to pay the retiral benefits including pension, gratuity, provident fund amount, leave encashment and group insurance as also arrears of salary payable to the petitioner who has superannuated from service on 31.12.2003.

(3.) NO counter affidavit has been filed on behalf of the respondent Jharkhand State Electricity Board. However, from annexures filed by the petitioner, it appears that though the petitioner was initially appointed under the Patna Electric Supply Undertaking, he retired from service under the JSEB in 2003. Prima facie, it appears that the petitioner is entitled to his retiral benefits including arrears of salary, which have not been paid to him. Furthermore the representation filed by the petitioner has not been disposed of.
