JUDGEMENT

(1.) Heard learned counsel for the petitioner and learned counsel for the respondents.

(2.) The petitioner is aggrieved by the order dated 30.01.2001, passed by the learned Presiding Officer, Labour Court, Dhanbad in Misc. Case No. 02 of 1996, whereby the application filed by the petitioner for setting aside the ex parte Award was rejected for non-prosecution. The petitioner has also prayed for quashing of the Award dated 05.01.1996, passed in Ref. Case No. 09 of 1994, by which the termination was held to be bad and the concerned workman was ordered to be reinstated in service with full back wages.

(3.) It is the case of the petitioner that the Government of Bihar through the Ministry of Labour, Employment & Training raised the dispute arising between the parties for adjudication vide notification No. 3/D/11019/93 L&E-219 dated 10.02.1994. The terms of reference are as follows:-
