(1.) The dispute pertains to surrender of the official accommodation which was given to the petitioner. He has superannuated from service on 30.04.2014. He has taken a plea that when he tried to hand over possession of the official accommodation to Bharat Coking Coal Limited, he was directed to hand-over possession to the F.C.I., which allegedly refused to take possession. The respondents have pleaded that after 28.07.2014 he has not approached the respondents.

The learned counsel for the petitioner submits that the petitioner had, in fact, handed over possession of the quarter to the management, however, I find that there is no proof thereof attached by the petitioner. It is not pleaded by the petitioner that after he handed over possession of the quarter to the respondents, they refused to grant possession certificate.

Be that as it may, the Project Officer, Bharat Coking Coal Limited, Kusunda Area-respondent no.5, shall accept handing over of the quarter, once the petitioner approaches him and shall issue 'No Dues Certificate' for release of the remaining retiral benefits to the petitioner, in accordance with law.
