JUDGEMENT

(1.) I.A. No. 5726 of 2017

(2.) It was submitted by the counsel for the appellant that the appellant has remained in custody more than three months and the appeal of the year, 2003-04 is being heard and there is no likelihood to be heard the instant criminal appeal near future. It is further submitted that there is contradictory statement about the identity of appellant, seized vehicle and about the used and recovered arms by prosecution witnesses.

(3.) Learned APP has opposed the prayer for bail and submitted that witnesses have supported the case of prosecution.
