JUDGEMENT

(1.) Heard learned counsels for the parties.

(2.) Petitioner Ashok Kumar Singh being aggrieved by the order dated 04.02.2011 passed by the Chief Judicial Magistrate, Dhanbad in C.P. Case No.500 of 2006 whereby and whereunder the complaint petition was dismissed.

(3.) The short fact of the case is that complainant/petitioner was granted bail by the Hon'ble High Court in Criminal Appeal No.1126 of 2005 arising out of S.T. Case No.298 of 1991 and accordingly bail bond was submitted on his behalf and after its acceptance the Court issued release order which was duly sent to the Jail Authority. Further case is that the O.P. No.2 herein at that relevant time was posted as Jail Superintendent, Dhanbad. Due to his conduct, the petitioner could be released from jail after two days from the custody. The petitioner at the relevant time was lodged in Central Jail, Hazaribag on transfer from the Dhanbad District Jail. Thereafter he filed a complaint case against the Jail Superintendent, Dhanbad who is O.P. No.2 herein but after recording the inquiry-witnesses, the court dismissed the petition, against that this revision has been filed.
