(1.) No one appears on behalf of the petitioner. However, Mr. Ashok Kumar, learned A.P.P. for the State is present.
(2.) Since this matter is pending since the year 2002, the same is being disposed of based on the materials available on record.
(3.) This revision application is directed against the judgment dated 18.09.2002 passed by the learned Additional District & Sessions Judge, Dhanbad in Cr. Appeal no. 101 of 1994, whereby and where under the judgment and order of conviction passed by the learned Judicial Magistrate (Railway), Dhanbad in R.P. Case No. 31 of 1984 convicting the petitioner for the offence punishable under section 3(a) of the R.P.(U.P.) Act and sentencing him to R.I. for one year has been affirmed.
