(1.) Heard learned counsel for the petitioner and learned counsel for the respondents.

The petitioner has approached this Court with a prayer for direction upon the respondents to appoint him on compassionate ground in place of his deceased father, after quashing of the order dated 16.07.2014, by which his claim for compassionate appointment has been rejected by the District Level Compassionate Appointment Committee.
(3.) The father of the petitioner was posted as Labour Enforcement Officer, Manoharpur under East Singhbhum district and while on duty, he died in harness on 06.08.2013. After death of his father, the petitioner preferred an application for his compassionate appointment before the Labour Superintendent (Agriculture Labour) at Chaibasa along with all relevant documents and educational certificates in the prescribed format. It is the further case of the petitioner that when no action was taken by the respondents, he gave reminder to the Labour Superintendent and after receipt of the same, the Labour Superintendent sent a letter to the Labour Commissioner, Ranchi on 20.11.2013 stating therein the factual aspects of the petitioner's case and requested him to take appropriate action in this regard. Thereafter, on 16.07.2014, a meeting of the District Level Compassionate Appointment was held, in which the case of the petitioner had also been considered and rejected in view of the fact that three members of his family are in government service and rest are majors and hence, there is no financial constrain in his family.
