JUDGEMENT

(1.) Reference may be made to the various orders passed in this contempt petition from time to time, specially the orders dated 7th July 2017, 28th July 2017 and 25th August 2017. Show-causes have been filed today on behalf of the opposite party no.2- Director-in-Chief, Health Services and the opposite party no.3- Director, Rajendra Institute of Medical Sciences, Ranchi.

Learned counsel Mr. Rajesh Kumar representing the opposite party no.3 submits that the petitioner has been promoted to the post of Nursing Superintendent and has also submitted her joining on the said post vide letters dated 21st August 2017 (Annexure-A series). It is further stated that out of 761 sanctioned posts available for nurses in RIMS, 411 nurses are currently working and rest 350 posts are vacant. 231 posts are vacant for Grade-A Nurses for which a roster clearance was received vide letter dated 28th July 2017 for 226 Grade-A Nurses posts. For recruitment on the said vacant posts through Jharkhand Staff Selection Commission request has been sent through letter dated 1st September 2017 to the Additional Chief Secretary, Health, Medical Education and Family Welfare Department (Annexure-B series). Out of total 88 sanctioned posts of Nursing Sister, 6 Nursing Sisters are working and 82 posts are vacant. These are promotional posts. At present 42 Grade-A Nurses appointed by the Government of Jharkhand are working in RIMS and for the promotion of the said 42 Grade-A Nurses to the post of Nursing Sister, a proposal was sent vide letter no.6142 dated 4.9.2017 to the Director-in-Chief, Health Services, Jharkhand. Steps for promotion of the rest 40 posts will be initiated by the RIMS after promotion of 42 Grade-A Nurses by the Health Directorate, Ranchi. Statements have also been made in respect of deputation of Nurse Grade-A in the Nursing College, RIMS for teaching purposes. It is further stated that as per rules laid down by the Medical Council of India / Indian Nursing Council, total 1833 posts were required for meeting the purpose of studying and teaching for medical and nursing students in the 1500 bedded Multi Special Teaching Medical College. A request letter was sent for sanction of the said post on 17th February, 2016 (Annexure-G). It is further stated that there are total 208 sanctioned posts in the third grade cadre of RIMS out of which 106 employees are working and 102 posts are vacant. For recruitment of the 58 vacant posts request has been sent through letter dated 7th September 2017 to the Additional Chief Secretary, Health, Medical Education and Family Welfare Department (Annexure-H). It is also stated that adjustment of total 30 contractual workers working since 12-15 years are under process as per the decision of the Governing Body and as per letter dated 30th September 2016 and gazette notification dated 8th September 2014. Rest 14 posts are promotional. Further letter no.6228 dated 7th September 2017 has been sent to the Additional Chief Secretary, Health, Medical Education and Family Welfare Department for recruitment of total 17 third grade posts in Super Specialty Departments of RIMS through the Commission. It is further stated that vide letter no.6112 dated 1st September 2017 sent to the Additional Chief Secretary, Health, request has been made for recruitment of 33 third grade posts in the Dental College through the Commission (Annexure-K).

(3.) Learned counsel for the RIMS submits that compliance of the order passed in the writ petition has been made now by promotion of the petitioner as Nursing Superintendent. The process relating to recruitment is being followed up by the Department with the Staff Selection Commission.
