(1.) Petitioner is apprehending his arrest in connection with Chouparan P.S. Case No. 189 of 2014, corresponding to G.R. No. 4727 of 2014, registered under Sections 414, 420, 467, 468, 469, 471, 34 of the I.P.C. and Section 30(ii) of the Coal Mines Act and Section 33 of the Indian Forest Act, pending in the court Smt. Garima Mishra, learned Judicial Magistrate, 1st Class, Hazaribagh or its successor court.

The case of the prosecution in short is that during night patrolling duty at Chordaha Post, one ASI Parshuram Pathak of Chouparan P.S. received information in the intervening night of 19/20.11.2014 that on two trucks bearing registration no. JH-10AN-1059 and UP-65-BT-6960 loaded with coal were proceeding towards Dehri-on-Sone, on the basis of forged papers. Informant near the check post noticed that on truck no. JH-10AN-1059, 19.990 MT steam coal was loaded and consignee was Anil Kumar Verma (petitioner) and consignment was booked in the name of Chandra Prakash Singh and on vehicle registration no. UP-65BT-6960, 19.960 MT coal was loaded and consignee was Anil Kumar Verma (petitioner), Proprietor of M/s Omkar Fuels, Dumri. Both the vehicles alongwith steam coal were seized. On the basis of aforesaid allegations, the instant case was instituted.

Learned counsel for the petitioner while pressing the anticipatory bail application submitted that petitioner is the Proprietor of M/s Omkar Fuels which is registered under small scale industries bearing Permanent Registration No. 2000604305 and manufactures Soft Coke on CFRI technology and procures coal from coal India Ltd. and has got consent from Jharkhand State Pollution Control Board and is registered under Commercial Tax Department having TIN No. 20762305443 and despite documents were produced before the I.O., but without verifying the documents, they have held up vehicle. So, the petitioner deserves the privilege of anticipatory bail.
