JUDGEMENT

(1.) Heard learned counsel for the parties.

(2.) The instant appeal arises out of impugned judgment and decree dated 28.3.2003 / 16.4.2003 passed by the Learned Additional District Judge-Vth, Palamau in Title Appeal No. 44 of 1979 where by the judgment and decree dated 15.6.1979/28.6.1979 passed by learned Additional Munsif, Daltonganj in Title Suit No. 1 of 1973 has been affirmed.

(3.) The Title Suit No. 01 of 1973 was preferred by the plaintiffs/ appellants herein for the following reliefs :-
