JUDGEMENT

(1.) Heard counsel for the parties.

(2.) Show-cause has been filed by the opposite party no. 5 on 27.04.2017. Counsel for the opposite parties points out that payment of 50% of the wages to the tune of Rs. 3,27,057/- in terms of order, has been made through Bill dated 22.01.2017 (Annexure-A and A/1); Group Insurance amount of Rs. 12,609/- has also been paid through Bill dated 22.04.2017 (Annexure-B series); District Superintendent of Education, Deoghar has submitted the documents for fixation of pension and gratuity to the Accountant General vide letter dated 18.04.2017; D.S.E, Deoghar has further requested the District Provident Fund Officer, Deoghar to activate the PF account number of the petitioner through letter dated 29.03.2017 (Annexure-D) for payment of provident fund. According to the opposite party, all steps have been taken towards compliance of the direction.

(3.) Counsel for the petitioner submits that pension and gratuity payment order has not been issued. He further submits that earlier, by office order dated 14.12.2016 issued by the D.S.E., Deoghar, a sum of Rs. 1,34, 513/- was also directed to be paid to the petitioner. It is further submitted that the provident fund amount remains due.
