JUDGEMENT

(1.) THE prayer in this petition is for a direction to the respondents to take urgent steps to protect the lives and health of the general public of Jamshedpur who are unprotected due to growing incidents of biting of pedestrians and two wheelers drivers by street dogs roaming about freely in the streets and by lanes of Jamshedpur and further for a direction to the Government to provide immediate medical aid to the victims of dog biting ensuring availability of life saving drugs and vaccines in Government hospitals and health centres and also to act promptly to control dog biting by enforcing the provisions of Sec. 349 of Bihar Municipal Act, 1922 .

(2.) A counter affidavit has been filed on behalf of the Deputy Commissioner, East Singhbhum, Jamshedpur. In the counter affidavit it is stated that according to the direction contained in letter No. 804, dated 8.7.2005 the local administration Jamshedpur has taken adequate steps to control the menace of dog biting in and around the township of Jamshedpur and in pursuance of the same medical facilities have been provided and a Committee has been formed to safeguard the public from dog biting. In that Committee the petitioner is one of the members. It is also submitted in the counter affidavit that the local administration are acting under the provisions as contained in Sec. 349 of the Municipal Act, 1922. The details given in the various paragraphs would indicate that proper steps have been taken and life saving drugs have been properly arranged and the Government hospitals have been directed in this regard.
