JUDGEMENT

(1.) SMT . Punam Kumari, the petitioner herein, has filed this contempt application for initiating the proceedings of contempt of court against the opp. parties for non -compliance of the order dated 8.8.2006 passed in W.P.(S] No. 3096/2004.

(2.) IN the said order, the following directions have been given: Respondents are required to pass appropriate orders for the period, i.e. 10th July, 2002 till the date of the judgment of the Division Bench on 9th April, 2003, subject to petitioner applying for leave for this period. Let petitioner apply for leave for this period. Respondent will consider her application within a period of two weeks and pass appropriate order in accordance with the stand taken in this writ petition. Respondents are, however, bound to pay the salary to the petitioner from the date of the judgment of the Division Bench in Letter Patent Appeal, which judgment has been implemented by them after a period of eight months. Let respondents release the salary/emoluments as mentioned above within a period of one month from today and issue pay slip for the period the petitioner rejoined after the judgment of Hon ble Division Bench.

ACCORDING to the opp. parties through the show cause filed before this Court, already reasoned order has been passed on 17.7.2007 in compliance of the order passed in W.P.(S) No. 3096/2004 by which the period of absence of the petitioner from 10.7.2002 to 9.4.2003 has been sanctioned as regularized and subsequently a pay slip issued by the Finance Department on 25.10.2007. On the basis of the said pay slip, a cheque of Rs. 3,08,585/ - was paid in favour of the petitioner against arrear of salary from 10.7.2002 to 6.1.2004 and current salary. The Finance Department has also issued a pay slip in favour of the petitioner for the period 7.1.2004 to 18.12.2006. Since the opp. parties received application on 8.11.2007 that she has applied for her pay slip on 7.11.2007 before the Finance Department, the Joint Secretary, HRD, wrote on 19.11.2007 requesting the Finance Department to issue pay slip in favour of the petitioner.
