JUDGEMENT

(1.) HEARD the learned counsel for the parties.

(2.) PERUSED the office notes and compliance made by the learned counsel for the petitioner.

(3.) THE present petition has been preferred against the initiation of the proceedings on the official complaint that the petitioner has utilised soils and other small minerals belonging to the State while completing the contract work as per assignment in construction of road. The Assistant Mining Officer, Chiabasa has lodged the complaint case all alleging that the petitioner has utilised morum, sand; stone chips and stone dust without paying cess/tax to the Mines Department.
