JUDGEMENT

(1.) The present application has been filed under Sections 438 and 440 of the Code of Criminal Procedure seeking anticipatory bail as the petitioners are apprehending their arrest in connection with Katkamdag P.S. Case No. 06 of 2015 corresponding to G.R. No. 396 of 2015, registered for the offence punishable under Sections 147/ 148/ 149/ 323/ 324/353/427/295(A) of the Indian Penal Code, now pending in the Court of learned Judicial Magistrate, Hazaribagh.

(2.) Heard learned counsel for both the sides.

(3.) Learned counsel for the petitioners submitted that there is general and omnibus allegation against all the petitioners. He further submitted that the petitioners were present at the spot. He also submitted that petitioner no. 4 is aged about 70 years and rest of the petitioners are students and they are never engaged in such type of activities. He also submitted that the petitioners have no criminal antecedent.
