JUDGEMENT

(1.) The petitioner prays for a direction upon the respondent to pay his arrears of suspension allowance for the period 12.06.2004 to 25.07.2006 on the ground that though he was kept under suspension during the said period, but no suspension allowance was paid to him.

While the petitioner was working as a Panchyat Sewak at Goilkera Block in the district of West Singhbhum, he was suspended on 12.06.2004, but ultimately vide letter dated 25.07.2006 his suspension was revoked and he resumed the charge of his office. The petitioner further submits that he has already been superannuated from service with effect from 30.04.2015, but the arrears of his suspension allowance for the period 12.06.2004 to 25.07.2006 has not paid to him.

(3.) Counsel for the respondents submits that suspension of the petitioner was revoked by order dated 25.07.2006. The said order has been brought on record by the petitioner as Annexure -1 to this writ petition. Relying on the said order the learned counsel for the State submits that in the last line of the said order it has been mentioned that the departmental proceeding against all Panchyat Sewaks would continue and a decision about payment of arrears of salary for the suspension period will be taken after conclusion of the departmental proceeding. Counsel for the State, thus, submits that in view of the order passed, a decision will be taken at the appropriate time when the departmental proceeding concludes.
