JUDGEMENT

(1.) Heard counsel for the parties.

(2.) Being aggrieved with the notice dated 29 th January 2010 issued by the respondent no.2 - Assistant Labour Commissioner (C), Dhanbad threatening to launch prosecution under Section 29 of the Industrial Disputes Act, 1947 for non -implementation of the award dated 11th April, 2003 passed by the Central Government Industrial Tribunal No.1, Dhanbad in Reference No.139/1991, the petitioner management has approached this Court.

(3.) The reference dated 9th December 1991 made by the Ministry of Labour, Central Government under Section 10(1)(d) and Sub - Section (2A) of the Industrial Disputes Act in the following language has been answered in favour of the management by the Central Government Industrial Tribunal No.1, Dhanbad by award dated 11th April, 2003.
