JUDGEMENT

(1.) Though this matter is listed for orders, by consent of the learned counsel for the parties, it is taken up for final hearing, heard and disposed of by this order.

(2.) The first respondent had issued an endorsement dated 16.03.2015, directing the petitioner to submit title deeds in respect of property bearing No. T-5(6) in Sy.No. 194/3 , Ward No. 6, Somwarpet Town, Madikeri. The said endorsement was challenged by the petitioner by filing W.P. No. 13920/2015. In the said case, this Court passed an order as under:-

(3.) Since the said undertaking has been given by the learned counsel for the respondent, no further directions need to be issued. But, it is hereby clarified that merely because the petitioner is granted the permission to repair the property in question, such a permission would not bestow any title upon the petitioner vis-a-vis the property in dispute.
