KARMI DEVI Vs. CENTRAL COALFIELDS LIMITED & ORS.

JUDGEMENT

(1.) The prayer of the petitioner, Karmi Devi, is for appropriate direction for quashing order being Ref. No. PO/DB/PD/G-I/07/6109-14 passed by the Personnel Manager, Dakra Project (Annexure-5), whereby the C.C.L has informed that it has no authority to decide the claim and thereby not released the Group Insurance amount of Rs. 5,00,000.00 in favour of the petitioner. And further to release the amount of Group Insurance along with statutory interest since premium amount from the salary of the petitioner husband had been regularly deducted.

(2.) The facts as claimed by the petitioner is that the husband of the petitioner namely Sitan Gope was employee of the Respondent Company and his Code No. was 071916 and was working at N.K. Area, Dakra Project as "Coal Breaker". Sitan Gope died during the tenure of his service in harness on 18.07.2000 leaving behind his widow (the petitioner).

(3.) That after the said incident the Respondent Authority vide Office Order No. 2720-22 dated 01.09.2000 struck off the name of said Sitan Gope from the Roll of the Colliery.
