JUDGEMENT

(1.) Seeking promotion with retrospective effect since 1980 and consequent benefits including difference in wages, the instant writ petition has been filed.

(3.) The petitioner was appointed as Underground General Mazdoor on 10.06.1980. He qualified the examination for Mining Sirdar's Certificate on 26.09.1997. The petitioner was accordingly regularised as Mining Sirdar-cum-Shot Firer in Technical and Supervisory Grade-C w.e.f. 08.01.1998. Subsequently, he appeared in the examination for "Overman" for which a certificate was issued on 13.09.2004, however, the petitioner did not tender the original document with the department and accordingly, his candidature was considered only in the meeting of Departmental Promotion Committee held on 05.10.2005. The petitioner has been granted promotion w.e.f. 08.04.2006 and from that date all benefits to the post of "Overman" have been granted to him.
