(1.) Heard learned counsel for the parties. Petitioner made an application for grant of no objection certificate under the Explosive Act, 1884 and Explosive Rules, 2008 made therein for establishing a wholesale kerosene oil depot which includes storage tank at Naya Bazar, Rajmahal, District Sahibganj. No objection certificate has already been issued in favour of the petitioner as per the statements made in the counter affidavit supported by Annexure -A dated 11th September, 2015.

Learned senior counsel for the petitioner submits that the respondents have indicated in the said counter affidavit itself that application for grant of wholesale/retail licence for kerosene oil under the Bihar Trade Articles (Licence Unification) Order, 1984 is being processed and a report has been asked for. The respondent authorities will take a decision on the same which was pending due to Panchayat election underway. Learned senior counsel further submits that now after petitioner has complied with the necessary requirements in support of her application and that matter is being processed on recommendation at the appropriate level, the competent authority/respondent no.2, Deputy Commissioner, Sahibganj may be directed to take an early decision in the matter.

Learned counsel for the respondents -State submits on the basis of the instructions contained in the same counter affidavit that such a direction may be issued upon the competent authority/respondent no.2. Accordingly, writ petition is disposed of so that an appropriate decision be taken by the respondent no.2 on the application of the petitioner for grant of wholesale kerosene oil dealer licence in accordance with law within a reasonable time, preferably within a period of ten weeks from the date of receipt of a copy of this order.
