JUDGEMENT

(1.) A supplementary show -cause filed on 15.07.2014 encloses the reasoned order at Annexure -B dated 26.05.2015 and Notification of promotion of the petitioner and several other Assistant Engineers to the post of Executive Engineer from the date indicated therein vide Annexure -A dated 19.06.2013.

(2.) Counsel for the opposite party submits that direction to consider the claim of the petitioner for promotion to the post of Executive Engineer has been considered in accordance with law and therefore, no case of contempt survives.

(3.) Counsel for the petitioner submits that the decision to grant promotion from 2013, is not in consonance with the Circular dated 05.07.2002 also referred to in the decision rendered in the case of Nand Kumar Ram vs. State of Jharkhand & others [2006(1) JLJR 443].
