JUDGEMENT

(1.) THE grievance of the petitioner is that though his shop in the name and style of "Chandan Rubber Stamp and Co -cum -Scooter Repairing" was separate from the commercial complex, namely, Roshpa Tower bearing Holding No. 728A, Ward No. V, Main Road, Ranchi, the same was illegally demolished in execution of the order against M/s Roshpa Tower.

(2.) THE petitioner claims that he is holding the said premises by virture of an independent lease and he is in possession of the same in his legal right and interest and his occupation is not unauthorized. The petitioner has stated that even after demolition, he is not being allowed to reconstruct his shop by the Ranchi Regional Development Authority. The petitioner requested the authorities of the Ranchi Regional Development Authority and filed representation, but in spite of the same, neither any reasoned order has been passed, nor the petitioner is being allowed to reconstruct his shop. The petitioner, however, abandons the claim of damages in this petition praying leave to make such claim before the appropriate Court.

(3.) WITH the said observation, this writ application is disposed of.
