JUDGEMENT

(1.) PETITIONER 's father died -in -harness on 6.5.2000. Petitioner claims compassionate appointment and for that earlier he has filed writ petition being WPS No. 3798 of 2005. The said writ petition was disposed of on 10.8.2005 with a direction to the respondents to take decision on the application of the petitioner for compassionate appointment. Respondents took decision, which has been challenged in this case. In the said decision, it is stated that petitioner's father was continuously absenting from duty from 29.9.1997 and for that reason after holding departmental enquiry, he was dismissed from service of the company vide dismissal order dated 12.10.2000.

(2.) HAVING regard to the grounds taken by the respondents in their decision, no case is made out, unless the dismissal order of the petitioner from service is set aside by a court of competent jurisdiction.
