JUDGEMENT

(1.) The petitioner was examined by a doctor and was found to be a juvenile. When a petition was moved for bail it was rejected on the only ground that the petitioner was wearing a sweater which belongs to the deceased.

(2.) Learned Counsel appearing for the petitioner submits that Raja Singh being the main accused and the petitioner being the friend of the main accused, Raja Singh, mere recovery of sweater from the petitioner cannot by itself a ground to refuse bail to the petitioner on the ground that he has committed offence by conspiring with his friends and admirers.

(3.) On the above contention, I have heard Counsel appearing for the State, perused the judgment and order of the Courts below and other materials and finding substance in the argument, I direct that the petitioner, Rishi Kumar, shall be released on bail on condition that he shall execute a bond for a sum of Rs. 5,000.00 (Five thousand) with one surety of the like amount to the satisfaction of Additional Chief Judicial Magistrate, Koderma in Koderma P.S. Case No. 6/2002 (T.R. No. 326 of 2005).
