JUDGEMENT

(1.) HEARD the parties.

(2.) IT appears that the court below refused to accept the written statement on the ground that it was filed after two months from the time fixed in the Code of Civil Procedure.

(3.) THE writ petition is allowed and the impugned order dated 30.11.2005 passed by Sri Rajiv Ranjan, Munsif, Bermo at Tenughat, in Title Suit No. 31/2005 is set aside. The court below is directed to accept the written statement and proceed with the hearing of the suit.
