JUDGEMENT

(1.) Reference may be made to the order dated 14.9.2006 which reads as under:

Heard the learned counsel for the parties and the learned Advocate General and perused the affidavit filed by the Government of India through Department of Heavy Industry and Public Enterprises, Govt, of India; the Chief Secretary, Govt, of Jharkhand, on the issues of revival of Heavy Engineering Corporation Limited. In the meeting, all the pros and cons have been discussed and it was finally decided that the ground survey of the vacant land shall be conducted to ascertain the position so that it could be finally ascertained as to which portion of 3000 acres of land the Government of Jharkhand intends to retain/re-convey. On the other hand, the H.E.C. shall also ascertain and disclose as to which portion of the land it intends to, retain for the Industries. It is informed that the survey has already been started and it shall be completed within a short span of time.

(3.) In the aforesaid premises, the Government of Jharkhand and the H.E.C. are directed to file affidavit giving description of the land which both of them intend to retain so that a final order could be passed in this regard. The affidavits shall be filed on or before 1st Dec., 2006. The matter shall be again listed on 20th Dec., 2006.
