JUDGEMENT

(1.) W.P.(S) No. 1421 of 2015 At the outset, the learned counsel for the petitioners submits that, though the petitioners and other similarly situated persons have been working on the post of Court Managers, consolidated salary fixed for them has not been paid to them.

Mr. Jai Prakash, the learned Additional Advocate­General for the respondent­State of Jharkhand states that in so far as, payment for the month of March, 2015 is concerned, that would be released forthwith. Mr. B. B. Mangalmurti, the Principal Secretary­cum­Legal Remembrancer, Law (Judicial) Department, Government of Jharkhand - respondent no. 2 is present in the Court with the original file. The learned Additional Advocate­General, on instruction, submits that, the Hon'ble Law Minister has accorded approval to the proposal for creation of 26 posts of Court Managers initially for five years. It is submitted that, the matter has been taken in right earnest however, there are certain formalities which have to be completed and therefore, final decision in the matter has not been taken.

The learned counsel for the petitioners submits that, creation of the posts for the Court Managers was recommended by the 13th Finance Commission and accordingly, the appointment of the petitioners and other Court Managers have been made during the period 2012­2013. The Gazette Notification was published by the Government of Jharkhand whereunder, the eligibility, functions, emoluments and responsibility of the Court Managers were provided. The petitioners have been duly selected and they have been working on the post of Court Managers. The Court Managers working in the High Court have been paid a consolidated sum of Rs. 50,000/­ per month and other Court Managers working in different judgeships under the High Court of Jharkhand have been paid Rs. 40,000/­ per month. The services of the petitioners and other Court Managers have been lastly extended upto 31.03.2015. It is stated that vide letter dated 19.01.2015, the Registrar­General of High Court communicated the decision of this Court to the respondent no. 2 to move the concerned authority of the State Government for creation of 26 posts of Court Managers. The learned Additional Advocate­General, on instruction from the respondent no. 2 has submitted that, pursuant to letter dated 19.01.2015, the Hon'ble Law Minister has accorded approval for creation of 26 posts of Court Managers.
