JUDGEMENT

(1.) Heard counsel for the parties.

(2.) Writ petition was preferred in the year 2007 assailing the order of suspension contained in Memo No. 239 (B) dated 18.07.2002 (Annexure -2) issued by the Respondent No. 3 -District Panchayat Raj Officer, West Singhbhum, Chaibasa on the orders of Deputy Commissioner, West Singhbhum on the grounds of unauthorized absence and disobedience of orders of superior authority.

(3.) Petitioner was posted as a Panchayat Sewak in Gopinathpur Panchayat under Chakradharpur Block in West Singhbhum at the relevant point of time. The petitioner has superannuated as per statement made by him through supplementary affidavit filed on 22.07.2015 while under suspension. Petitioner therefore seeks payment of full salary for the period of his suspension till his retirement as suspension would be deemed to have come to an end on his retirement upon cessation of employer -employee relationship. He also has sought payment of entire post retiral benefits in the revised pay scale along with its arrears. Petitioner has contended that no charge sheet had ever been issued, nor any inquiry was conducted against him.
