JUDGEMENT

(1.) The appellant was put on trial on the charge of committing murder of his grand-mother Solma Murmu. The court having found the appellant guilty for the said charge convicted him for the offence punishable u/s 302 of the Indian Penal Code vide its judgment dated 20.05.2006 passed in S.T. Case No. 40 of 2002 and sentenced him to undergo imprisonment for life vide order dated 22.05.2006.

(2.) The case of the prosecution is that on 21.08.2001 at about 7 p.m. the informant-Phulmuni Murmu (P.W.2), while was taking her mother Solma Murmu (deceased) inside the house, the appellant Palu Murmu came all on a sudden and gave three-four lathi blows over the head of the deceased as a result of which she died. On the next day i.e. on 22.08.2001 when Satyendra Narayan Singh, officer incharge of Baharagora Police Station came to the house of the informant at about 1.30 p.m., he recorded the fardbeyan (Ext.3) of informantPhulmuni Murmu (P.W.2), wherein the informant narrated the same fact which has been stated above.

(3.) On such fardbeyan, a First Information Report (Ext.2) was registered and the case was taken up for investigation during which the I.O. did hold inquest on the dead body and then sent the dead body for postmortem examination which was conducted by Dr. A.K. Choudhary (P.W.1), who upon holding autopsy on the dead body did find following injuries :-
