(1.) HEARD learned counsel for the parties.

(2.) THE lis involved in the instant writ petition again calls for interpretation of provisions of Clause 3 (Ga) (ii) of Adv. no. 93/11, under which a recruitment exercise was held by Jharkhand Academic Council for filling up the post of Assistant Teachers in Upgraded Middle School under Government of Jharkhand. The said Clause is being quoted hereunder: -

IT would not be also out of place to mention herein that the aforesaid Clause is in conformity with Jharkhand Nationalized Middle School (Service Conditions) Rule, 2004, as amended vide notification dated 30th September, 2011, more specifically Rule 4(3)(Ga), Annexure -A to the counter affidavit of respondent -JAC also quoted hereunder: -
