GOPI RAVIDAS Vs. STATE OF JHARKHAND

JUDGEMENT

(1.) Heard learned counsel for the parties. Petitioners herein are seeking regularization in IV th Grade in the district of Hazaribagh. They are said to belong to Scheduled Caste and Other Backward Caste Category. It is the petitioners' case that their names have also occurred in the panel prepared by the District Authorities of Hazaribagh in the year 2005 at serial nos. 629, 591, 476, 485, 525, 542 and 557. Petitioners have alleged that their cases have not been considered though several persons from the same panel below them have been appointed.

(2.) Petitioners herein have filed supplementary affidavit on 22.07.2015 enclosing the entire panel, Annexure - 28.. They have also stated that persons at serial nos. 537, 558, 570, 574,575, 609, 630, 632, 634, 654 and 655 have been appointed from the same panel.

(3.) Respondents have filed their supplementary counter affidavit in reply to the averments made to the said supplementary affidavit. It is stated therein that advertisement is of 2002 for filling vacancies of IVth Grade employees of Hazaribagh as per the terms indicated therein. The petitioners were not entitled for appointment in IVth grade post as petitioners were engaged on daily wages as per the requirement of th work in different Department such as District Leprosy Officer, Hazaribag in respect of petitioner nos. 1 and 2. Likewise other petitioners were also engaged in different departments and are not entitled for regular employment. In the year 2005, merit wise panel was prepared for appointment in the IVth Grade post as per the direction pass in one or the other writ petitions and LPA No. 455 of 2005.
