JUDGEMENT

(1.) Heard learned counsel for the parties.

(2.) Petitioner came before this Court being aggrieved by the decision of the Deputy Commissioner, Sahibganj contained in memo no. 826 dated 05.11.2012, Annexure -9, issued under the signature of District Superintendent of Education -cum - District Programme Officer, Jharkhand Education Project, Sahibganj, respondent no. 5 by which his representation for appointment as Para Teacher in Upgraded Middle School, Karikandar, Borio Block, District Sahibganj was rejected on the ground that eligibility for appointment to the post of Para Teacher has been changed and requirement of passing of Teachers' Eligibility Test is to be observed in view of enforcement of the Right of Children to Free and Compulsory Education Act, 2009 and NCTE Notification dated 23.08.2010 laying down the eligibility conditions. These conditions were brought into effect from 01.04.2010 and no untrained teacher could be appointed thereafter.
