JUDGEMENT

(1.) THIS case was taken up on 23rd September, 2004 when the following order was passed : This application has been preferred by the petitioner for commanding upon the respondents to grant him promotion to the post of Surveillance Inspector with effect from 2nd August, 1989. It appears that the petitioner was earlier promoted as Surveillance Inspector and later on reverted vide order dated 18th September, 2000. It was challenged by the petitioner in C.W.J.C. No. 1278 of 2000. The said case was disposed of by this Court vide order dated 14th February , 2001, wherein the following order was passed :

IN pursuance of Court 'sorder, Mr. Shivendu, Commissioner -cum -Secretary, Health and Family Welfare Department, Government of Jharkhand, Ranchi and Dr. Pradeep Baskey, Incharge State Malaria Officer, Health and Family Welfare Department, Government of Jharkhand, Ranchi have appeared and filed their affidavit.

(3.) FROM the order dated 14th February, 2001 passed in CWJC, No. 1278 of 2000, it appears that the dispute aforesaid was not resolved by this Court. The Court noticed the submission that the post of Surveillance Inspector was stated to be filled up by promotion, but in the end, while interim arrangement was allowed to continue, it was observed that such arrangement may continue till regular appointment/promotion is made.
