JUDGEMENT

(1.) In this writ petition the petitioner has prayed for quashing of the order dtd. 4/7/2023 passed by the respondent no.2 in connection with Revision Case No.61 of 2022 whereby and whereunder respondent no.2 has affirmed the Communication No.983/M dtd. 23/9/2022 passed by the respondent no.3 by which the registered mining lease of the petitioner was terminated prematurely. The petitioner has also prayed to quash the Communication No.983/M dtd. 23/9/2022 passed by the respondent no.3 without issuing any thirty days' notice which is statutory requirement under Rule 27(2) of Jharkhand Minor Mineral Concession Rules, 2004 read with Lease Deed Part IX/3.

The learned counsel for the petitioner has drawn attention of this Court with regard to the order dtd. 29/1/2024 passed by this Court in W.P(C) No.5030 of 2023 titled 'M/s Jindal Stone Works through its proprietor Kanhaiya Kumar Khudania v. State of Jharkhand and Ors.' stating that the issue involved in that writ petition is similar to the present one.

Therefore, in view of the detailed reasons stated in the order dtd. 29/1/2024 passed by this Court in W.P(C) No.5030 of 2023 titled 'M/s Jindal Stone Works through its proprietor Kanhaiya Kumar Khudania v. State of Jharkhand and Ors.', this writ petition stands disposed of in terms of the said order.
