JUDGEMENT

(1.) THIS contempt application has been filed making a grievance that the order dated 10.12.2002 passed in WP (C) No. 3672 of 2001 as contained in Annexure 2 hereof has been disobeyed.

(2.) IT is stated that after obtaining the certified copy of the judgment, the petitioner filed an application on 27.12.2002 which was followed by a reminder on 29.3.2003 vide Annexures 4 and 4/1. According to the petitioner, on 7.5.2003 by Annexure -5, the Divisional Forest Officer Deoghar, asked the petitioner to appear in a hearing which was scheduled to be held on 12.5.2003. It appears that the petitioner received that letter belatedly and therefore, as has been stated in paragraph 28, it filed an application (Annexure 6) wherein it stated that it had received the letter dated 7.5.2003 only on 16.5.2003 and therefore could not attend. The petitioner accordingly, made a prayer for appropriate orders on that letter. The petitioner has stated that in the first week of June, it received an order dated 26.5.2003 issued under Memo No. 1987 dated 29.5.2003 whereby and whereunder the claim of the petitioner was rejected.

(3.) A case has been filed on behalf of the opposite party No. 3 i.e., the Division Forest Officer, Deoghar.
