RAJU RAM Vs. STATE OF JHARKHAND

JUDGEMENT

(1.) A copy of the report received from the officer-in-charge of Chouparan PS has been tendered in the Court. Taken on record.

(2.) This application has been filed by the convict, namely, Raju Ram seeking provisional bail/interim bail to perform the last rites of his mother, uncle and aunt who have died in a road accident on 9/6/2023. The officer-in-charge of Chouparan PS has stated that a report on investigation of Vivek Vihar PS Case No. 138 of 2023 which has been lodged under Sec. 279 and 304-A of the Indian Penal Code is awaited. There is no adverse report by the officer-in-charge of Chouparan PS against the applicant.

(3.) The applicant has been convicted and sentenced to RI for 20 years and fine of Rs.1.00 Lakh under Sec. 15(C) of the NDPS Act. Having regard to the facts and circumstances in the case, the applicant, namely, Raju Ram is directed to be released on 'provisional bail' till 27/6/2023, on furnishing bail bond of Rs.10,000.00 (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Hazaribag in connection to NDPS Case No. 10 of 2018 arising out of Chouparan PS Case No. 123 of 2018 subject to the condition that one of the bailors shall be a close relative of the applicant.
