JUDGEMENT

(1.) Heard learned counsel for the parties.

(2.) It reveals from the written report that a Tata pick up van 207 bearing registration No.JH 05 AR 2469, loaded with pora coal packed in different bags weighing about 8 quintal, was seized by the police. The driver of the vehicle as well as owner of coal were apprehended.

(3.) It is submitted that petitioner happens to be owner of said pick up van and he has no concern with the illegal trade of coal. It is evident from the written report itself that owner of coal was Rajesh Malakar who was arrested on the spot.
