(1.) Anticipatory bail application filed by Indra Deo Prasad, is moved by Sri Ramesh Kumar Singh, learned counsel for the petitioner and opposed by Sri Arun Kumar Pandey, learned Additional P.P. for the State.
(2.) This is a case under Sections 304B/34 of the I.P.C. Petitioner is father-in-law of deceased's sister-in-law. F.I.R. reveals that petitioner has been implicated in this case merely on suspicion. There is no allegation against him that he demanded dowry and / or torture deceased for the said demand. It also appears that police, after investigation, has not sent him for trial, but the learned Magistrate took cognizance against him. However, learned Additional P.P., after going though the case diary, had submitted that there is absolutely no legal evidence against the petitioner.

Considering the aforesaid facts and circumstances, I allow the anticipatory bail application and direct petitioner to surrender in the court below on or before 28.06.2013 and in the event of his surrender, the learned court below is directed to enlarge the petitioner, above named, on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bokaro, in connection with Chas P.S. Case No. 231 of 2012 corresponding to G.R. No. 1276 of 2012, subject to the condition as laid down under section 438(2) of the Cr.P.C.
